Mingo County Booking Photo Records
A mugshot is an intake photograph tied to a booking. For an adult processed through Southwestern Regional Jail and Correctional Facility, WVDCR Policy Directive 151.00 says three adult intake photographs are created and the front view is used as the Offender Information System header image. Policy Directive 400.01 also links the jail admission process to mugshot and OIS work. Those policies establish that WVDCR creates and holds images. They do not promise that every photo stays on the public web after release.
The agency split matters in Mingo County. Southwestern is a state-run regional jail in Holden, Logan County. It serves Mingo, but it is not a Mingo Sheriff jail. WVDCR normally owns the Southwestern booking image. The Sheriff may hold a different photograph only if that office created or received one as part of its own arrest record. A court holds the order and later expungement record. Asking each source for the record it made avoids an incomplete response.
Release status must be confirmed apart from the image. A current photo can accompany an active jail record, a prison record may retain a photo after discharge, and an older official post can outlast the event by years. Use the exact status and date from WVDCR, VINE, or the court record rather than reading custody status from the mere existence of a face image.
Mingo County Mugshot Sources
No single official gallery covers people released from Southwestern. The right channel depends on whether the image came from a regional-jail booking, a later prison intake, a Mingo law-enforcement event, or a public court process. Official sources are strongest because they can identify the creator and the record context. News and commercial copies may remain visible, but they can be old, mislabeled, or detached from a later disposition.

The WVDCR regional-jail search is an active-custody lead. Its information changes quickly and may not show a person's true current location, release date, or status. Why Mingo Has No Mugshot App
No official Mingo Sheriff mobile app with mugshots was found. Researchers also found no official Sheriff roster, recent-release photo gallery, or local booking-photo feed. The statewide WVDCR jail system fills the custody-search role because Southwestern, not the Sheriff, is the adult regional jail serving Mingo County. A third-party app should not be labeled official merely because it uses the county name or copies public booking data.
This negative finding changes the search path. Start with WVDCR OIS for a live image attached to the correct identity, then make a focused WVDCR request if the image is absent. Ask the Sheriff only about a separate photo in a Sheriff-created arrest file. The official Mingo County Sheriff source provides agency contact information but no inmate or release-photo widget.
WVDCR policy is the basis for knowing that Southwestern creates intake photos. Publication is a separate issue. A front image may be placed in the OIS header, yet no official rule located in the research states how long a released booking photo remains visible. “No published retention window located” is the accurate answer.

Request Mingo County Booking Photos
A focused request gives the custodian enough detail to locate the right image without demanding the full offender file. Under West Virginia Code §29B-1-3, a public body must act as soon as practicable and within five days, excluding weekends and legal holidays, by producing the record, setting an inspection time, or issuing a written denial. The agency may charge actual reproduction cost but not a search, retrieval, or man-hour fee. This is a response rule, not a promise that the photograph must be disclosed.
WVDCR Policy 142.00 treats broad offender files, including legal and booking files, as confidential except for authorized disclosures. West Virginia FOIA also contains exemptions. Ask for a segregable public image and invite redaction of exempt material. Request the photo separately from the release sheet so a dispute about one item does not stall the other.

Mingo County Photo Publication Limits
Official law-enforcement social posts and local news reports sometimes show an arrest image. They document a selected event, not all Southwestern bookings or releases. A post can remain online after a charge changes, a case ends, or the person leaves custody. Its date is usually the publication date, not the release date. Use the underlying agency and court records to establish what happened later.
Commercial mugshot and data pages are still weaker. They may copy an old image without a disposition, combine records belonging to different people, or charge for removal. No commercial publisher or removal vendor is linked or endorsed. An unofficial image should never replace the WVDCR identity fields, the Mingo court order, and the dated custody event.

Mingo County Expungement Photo Path
West Virginia's acquittal and dismissal expungement law makes photographs part of the record that may be addressed. Under §61-11-25, the defined records include arrest records, fingerprints, photographs, index references, and electronic material. An eligible person found not guilty, whose charge was dismissed outside the excluded plea arrangement, or who completed a qualifying diversion matter may petition the circuit court where the charge was filed. A petition ordinarily cannot begin sooner than 60 days after acquittal or dismissal, and the full statute's exclusions still apply.
For a Mingo case, that lawful path runs through Mingo Circuit Court, not through a commercial removal service. Eligible conviction expungement is governed separately by §61-11-26, which covers specified misdemeanors and nonviolent felonies subject to waiting periods and many exclusions. A court order can lead to sealing and limited “no record” treatment as the statute provides. It also explains why an old image or index entry may no longer be open to the public.
Expungement is not a license to reconstruct sealed material. When a lawful public source no longer returns the record, respect that access result. If an official image remains after an order takes effect, direct the correction request to the agency that controls the image and include the order. A missing image also cannot prove that no booking ever happened.
Note: Mingo Circuit Court is the local legal route for an eligible expungement; a commercial remover cannot issue or replace a court order.
Mingo County Social Photo Rules
West Virginia Code §62-1-6a is narrow. It generally limits social-media sharing of booking photographs for alleged minor offenses by a covered law-enforcement agency, subject to listed exceptions such as a public-safety reason, fugitive status, an imminent threat, or a court order. The statute expressly excludes DCR and its subordinate organizations from the definition used in that section. It therefore should not be presented as a blanket rule requiring removal of a Southwestern OIS image.
For a covered agency's social-media post, the statute describes removal within 14 days after a qualifying request by the subject or authorized representative when an enumerated favorable outcome exists. Those outcomes include dismissal, no indictment, acquittal, or a conviction that was reversed, vacated, or nullified. The procedure is not a universal deletion right for every database, publisher, outcome, or booking photo.
